TERMS AND CONDITIONS

These terms apply to every order placed on our website. If you use the site or place an order, you agree to these conditions. Please read them carefully. If you have questions, you can always reach us at fotofly.biz@gmail.com.

1. About Us

Fotofly is a personalised print business based in the Netherlands.
We sell custom products that are created especially for you, such as canvas prints, framed prints, posters, mugs, clocks and other photo gifts.

2. How Orders Work

When you place an order and complete the payment, you enter an agreement with us.
Production starts shortly after payment. Most items are made to order. This means we create them based on your photos, text and design choices.

Before placing an order, please double check your details. This includes photo placement, spelling, colours and product size. Once production starts, we usually can’t make changes.

3. Personalised Products

Most Fotofly items are personalised. These items are created only for you. Because of this, they can’t be returned under the standard 14-day withdrawal rule that applies to regular online purchases in the EU. This exemption is allowed by law.

If there is a mistake made by us or your item arrives damaged, we will fix it. More on that in the “Returns and Replacements” section.

4. Using Your Photos

You must own the photos and artwork you upload, or you must have permission to use them.
By uploading files, you confirm the images do not break copyright laws and are not offensive or illegal.

We use your photos only to create your product. We don’t use them for marketing unless you give us permission.

5. Quality of Uploaded Photos

The final print depends on the quality of the photo you upload. If the photo is blurry, dark or too small, it may affect the result. We do our best to get the best outcome, but we can’t promise a perfect result if the original quality isn’t high.

Colours may look slightly different in print compared to your screen. This is normal with printed products.

6. Prices and Payment

All prices on the website include VAT for customers inside the EU.
Your location may influence the tax you pay because of EU VAT rules.
You can pay with the options shown at checkout. Orders are only processed after payment is completed.

7. Production and Delivery Times

Production times vary per product.
Shipping times depend on your location and the chosen shipping method.
Delays can happen during busy seasons or when carriers experience issues. We can’t take responsibility for delays after the package leaves the production facility, but we will help track it if needed.

Customs fees might apply for orders outside the EU. These fees are the responsibility of the buyer.

8. Returns and Replacements

Because our products are personalised, returns for unwanted items aren’t possible.
However, we will replace your item if:

  • it arrives damaged
  • it arrives with a printing error
  • the product is different from what you ordered

We may ask for clear photos of the item so we can solve the problem quickly.
Please contact us within 7 days of receiving your order.

9. Mistakes in the Order Details

We rely on the information you provide. This includes photos, text, colours and personalisation choices. We can’t replace or refund products that contain spelling errors or image issues that were present in the supplied file.

10. Right to Refuse Orders

We may refuse orders that contain copyrighted content, harmful material or images that are not allowed by law.

11. Privacy and Data

We handle your data with care. We follow Dutch and EU privacy laws.

12. Liability

We’re responsible for delivering your product in good condition.
We aren’t responsible for:

  • delays caused by shipping carriers
  • low-resolution uploads
  • colour differences due to screen settings
  • issues caused by incorrect address input

Our responsibility is limited to the value of the order.
